ISLAMABAD:June 30, 2021 The Islamabad High Court disposed of the petition against the Federal Investigation Agency (FIA) of journalist Asad Tur with instructions to send a notice to Asad Tur with a copy of the complaint and take action as per law.
Islamabad High Court Chief Justice Athar Minallah heard the case against the FIA cybercrime for ‘misuse’ of powers.
FIA Director Cyber Crime appeared before the Islamabad High Court where a dialogue took place between Chief Justice Athar Minallah and Director Cyber Crime.
Chief Justice Athar Minallah remarked that the court had asked him several times but the court orders were not being complied with. To give notice to anyone without giving a reason is tantamount to threatening and intimidating him.
The Chief Justice remarked that in order to exercise his powers, you should have SOPs in which the investigating officer should investigate the matter before issuing a notice.
Expressing anger, the Chief Justice said that what is the way for the FIA investigating officer to send notices on WhatsApp?
“We have thousands of complaints pending at the moment,” the FIA director of cybercrime said.
“There are some basic rights that need to be taken care of. You should exercise your authority carefully and eliminate the impression that the authority is being misused by the FIA cybercrime,” he said.
Chief Justice Athar Minallah remarked that the notice you give to someone has implications, you should make sure that the whole process is transparent, you do not write any date on the notice and say appear before us.
Chief Justice Athar Minallah remarked that a person whose dignity has been tarnished can be a complainant, it is not possible for anyone to speak against me, you can file an FIR on someone else’s complaint, it is not so. I have to be the complainant.
